Fake news has been the focus of debate, especially since the election of Donald Trump (2016), and remains a topic of concern in democratic countries worldwide, given (a) their threat to democratic systems and (b) the difficulty in detecting them. Despite the deployment of sophisticated computational systems to identify fake news, as well as the streamlining of fact-checking methods, appropriate fake news detection mechanisms have not yet been found. In fact, technological approaches are likely to be inefficient, given that fake (...) news are based mostly on partisanship and identity politics, and not necessarily on outright deception. However, as disinformation is inherently expressed linguistically, this is a privileged room for forensic linguistic analysis. This article builds upon a forensic linguistic analysis of fake news pieces published in English and in Portuguese, which were collected since 2019 from acknowledged fake news outlets. The preliminary empirical analysis reveals that fake news pieces employ particular linguistic features, e.g. at the levels of typography, orthography and spelling, and morphosyntax. The systematic identification of these features, which will allow mapping linguistic resources and patterns used in those contexts, contributes to scholarship, not only by enabling a streamlined development of computational detection systems, but more importantly by permitting the forensic linguistics expert to assist criminal investigations and give evidence in court. Busca-se, primeiramente, o sentido da arte no contexto de seu surgimento, sua valorização cultural e sua função social, para, posteriormente, mediante pressupostos da Teoria Crítica da Sociedade, verificar-se as contradições com sua desintegração na atualidade, apropriada pela indústria cultural como valor de mercadoria. Nesse trajeto, a reprodução técnica da obra de arte tornase o (...) fundamento categórico para a crítica e o desnudamento das formas decadentes sob as quais a arte é “visualizada” na modernidade. A redução das formas estéticas de percepção da arte expressa-se no desaparecimento da experiência, na incapacidade de narrar, na crise da transmissão, enfim, no ensino de arte. (shrink)

Cybercrime has increased significantly, recently, as a result of both individual and group criminal practice, and is now a threat to individuals, organisations, and democratic systems worldwide. However, cybercrime raises two main challenges for legal systems: firstly, because cybercriminals operate online, cybercrime spans beyond the boundaries of specific jurisdictions, which constrains the operation of the police and, subsequently, the conviction of the perpetrators; secondly, since cybercriminals can operate from anywhere in the world, law enforcement agencies struggle to identify the origin (...) of the communications, especially when obfuscation strategies are used, e.g. dark web fora. Nevertheless, cybercriminals inherently use language to communicate, so the linguistic analysis of suspect communications is particularly helpful in deterring cybercriminal practice. This article reports the potential of forensic translation in the fight against cybercrime. Although the term ‘forensic translation’ is typically understood as a synonym of ‘legal translation’, it is argued that the implications of forensic translation span beyond those of legal translation, to include analyses of language rights, of the right to interpretation and translation in legal procedures (in the EU), or even investigative and intelligence practices. Translation is a pervasive activity that is conducted, not only by professional translators, but also by lay speakers of language, often using machine translation systems. The ease of use of the latter makes it particularly suitable for cross-border criminal (e.g. extortion or fraud) and cybercriminal communications (e.g. cybertrespass, cyberfraud, cyberpiracy, cyberporn or child online porn, cyberviolence or cyberstalking). This article presents the results of the analysis of cybercriminal communications from a forensic translation perspective. It demonstrates that translation is frequently used to spread cybercriminal communications, and that reverse-engineering the translational procedure will assist law enforcement agencies in narrowing down their pool of suspects and, consequently, deter cybercriminal threats. One of the initial triggers for the development of the book was the perceived ambiguity of the binomials Design vs. Design Thinking and Innovation vs. Invention. Frequently, designers and innovation consultants are questioned by their clients about the relationships between these kind of concepts. Has the second emerged through the first, or vice-verse? Is one part of the other? Where are the similarities and which are (...) the differences? This conceptual incomprehension makes itself noticeable between many ambiguous concepts in the world of innovation and creativity. What is the difference between Radical and Disruptive Innovation? Or is Social Innovation the same as Social Intervention? And regarding Creativity, are Creativity and Creative Thinking the same? Taking literally the concept of emotional truth requires breaking the monopoly on truth of belief-like states. To this end, I look to perceptions for a model of non-propositional states that might be true or false, and to desires for a model of propositional attitudes the norm of which is other than the semantic satisfaction of their propositional object. Those models inspire a conception of generic truth, which can admit of degrees for analogue representations such as emotions; belief-like states, by contrast, (...) are digital representations. I argue that the gravest problem-objectivity-is not insurmountable. /// [Adam Morton] It is accuracy rather than truth itself that is valuable. Emotional truth is a dubious though attractive notion, but emotional accuracy is much easier to make sense of. My approach to accuracy goes via an account of what makes a story accurate. Stories can be accurate but not true, and emotions can be accurate whether or not they are true. The capacity for emotional accuracy, for emotions that fit a person's situation, is an aspect of emotional intelligence, which is as important an aspect of rational human agency as the intelligent formation of beliefs and desires. Elle lui confère des avantages importants et contribue à son succès reproductif. Pourtant ses avantages ne sont pas si évidents. La pensée ne figure ni dans les mécanismes de l'évolution qui ont façonné la vie, ni parmi les procédés dont se servent la plupart des organismes pour s'y maintenir. Dans Évolution et rationalité, Ronald de Sousa montre que, (...) pour comprendre les avantages de la pensée réfléchie, il faut changer nos présupposés relatifs à la rationalité et reconnaître la multiplicité de ses dimensions. La rationalité ne nous sert pas seulement à avoir des croyances vraies et à agir de manière efficace dans un environnement changeant. Elle nous aide à gérer nos plaisirs et nos peines dans le temps et nous permet d'envisager des situations qui n'existent pas. En général, le statut de la rationalité comme ensemble de capacités ayant évolué dans le cours de l'histoire naturelle de notre espèce, passant des tropismes aux désirs et de la détection à la représentation, n'a pas été pris suffisamment au sérieux. Suivre ce processus d'évolution de la rationalité permet de comprendre comment elle est devenue une norme, mais aussi pourquoi il lui arrive aussi souvent d'échouer. Ronald de Sousa a profondément modifié nos façons de concevoir les émotions. Avec Évolution et rationalité, il pourrait avoir une influence aussi décisive sur nos façons de concevoir la rationalité. The word "truth" retains, in common use, traces of origins that link it to trust, truth, and truce, connoting ideas of fidelity, loyalty, and authenticity. The word has become, in contemporary philosophy, encased in a web of technicalities, but we know that a true image is a faithful portrait; a true friend a loyal one. In a novel or a poem, too, we have a feel for what is emotionally true, though we are not concerned with the actuality of events (...) and characters depicted. To have emotions is to care about certain things: we can wonder whether those things are really worth caring about. We can wonder whether our passions reflect who we are, and whether they constitute fitting responses to the vicissitudes of life. So there are two aspects to emotional truth: how well an emotion reflects the threats and promises of the world, and how well it reflects our own individual nature. That is the starting point of this book, which looks first at the analogies and disanalogies between strict propositional truth and a looser, "generic" sense of truth. As applied to emotions, generic truth is closer to those original meanings: as in a portrait's fidelity or friend's loyalty. Taken in this sense, the notion of emotional truth opens up large vistas on areas of life essential to our existence as social beings, and to our concerns with beauty, morality, love, death, sex, knowledge, desire, coherence, and happiness. Each of those topics illustrates some facet of the dominant theme of the book: the crucial but often ambivalent role of our emotions in grounding and yet also sometimes undermining our values. Emotions act, in holistic perspective, as ultimate arbiters of values where different and independently justified standards of value compete. (shrink)

In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

Femininity and whiteness dominate Western nursing, silencing ontologies and epistemologies that do not align with these dominant norms while perpetuating systemic racism and discrimination in nursing practice, education, research, nursing activism, and sociopolitical structures. We propose Black feminist thought as a praxis to decenter, deconstruct, and unseat these ideologies and systems of power. Drawing from the work of past and present Black feminist scholars, we examine the ontological and epistemological perspectives of Black feminist thought. These include (i) the uniqueness and (...) particular experiences of people, (ii) the acceptance of ontological and epistemological pluralism of truths and ways of knowing, and (iii) the mandate for equity in the health, social, political, and environmental structures of society. By focusing our attention on lived experiences and voices of those systematically excluded in nursing practice, education, research, and society, Black feminist thought offers an anticolonial, antiracist, and antidiscriminatory foundation for more effectively upholding nursing's disciplinary mandate for social justice and equity. They would do so on roughly these grounds: the sense and reference of the name ‘Homer’ is determined, given the absence (...) of other reliable testimony, by the sole description: ‘Author of the Iliad and the Odyssey’. ‘Homer is the author of the Iliad and the Odyssey’ is therefore known a priori, hence necessarily true. Este trabajo plantear algunas ideas para descolonizar la historia. Realizar esta tarea requiere concebir el pasado como campo de conflicto entre fuerzas sociales y negar la existencia de una sola historia. Descolonizar es una intervención intelectual que se opone a las interpretaciones de la historia que reproducen la dominación moderna, capitalista, colonialista y patriarcal. Dichas interpretaciones utilizan el concepto de “línea abisal” para separar social y racialmente a los seres humanos, y el concepto de “tiempo lineal” para sostener una temporalidad (...) unidireccional, acumulativa, irreversible y progresiva. Descolonizar la historia significa denunciar la existencia de esa forma dominante de concebirla, y afirmar la construcción de una historia post-abisal y no-lineal que tome en cuenta la irrupción de los oprimidos en los procesos sociales. La “historia de las ausencias” y la “historia de las emergencias” son herramientas para descolonizar la historia ya que muestran que el pasado no está cerrado y exhiben cómo los oprimidos confrontan las formas de dominación utilizadas por los opresores para caracterizar a los vencidos: “epistemicidio”, “kairocidio” y “timécidio”. Wittgenstein analisa em sua obra tardia, a relação entre regra e sua aplicação. Neste contexto, emerge o tema sobre compreensão de regras. O autor possui uma concepção distinta da tradição no que se refere à compreensão de algo (seja uma palavra, seja uma regra). Compreender uma regra não é um fenômeno mental, mas um ato natural, uma habilidade dominada pelo treino e aplicação de uma técnica cujo critério é o comportamento público dos agentes. Em algumas partes, surge a discussão sobre (...) uma possível lacuna entre regra e aplicação que abriu margem para interpretações equivocadas. Contudo, Wittgenstein apenas considera esta lacuna para fins de investigação, e concluí que a lacuna seria improcedente. Este artigo visa analisar o debate wittgensteiniano por meio de evidências textuais com citações selecionadas da obra tardia do autor. Defendo que Wittgenstein possui uma postura naturalista e pragmatista com relação à aplicação e compreensão de regras e que, a lacuna entre regra e compreensão é aparente e ocorreria caso se adotasse um modelo mentalista de compressão da linguagem. Müller argues that the perceptual or “Axiological Receptivity” model of emotions is incoherent, because it requires an emotion to apprehend and respond to its formal object at the same time. He defends a contrasting view of emotions as “Position-Takings" towards “formal objects”, aspects of an emotion's target pertinent to the subject's concerns. I first cast doubt on the cogency of Müller's attack on AR as begging questions about the temporal characteristics (...) of perceptual events. I then argue that Müller's version of PT is not radical enough. On my attitudinal view, formal objects are not values but natural properties that justify specific affective or behavioral responses. Values are constituted only by a negotiated social aggregation of individual evaluative attitudes. (shrink)

This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. The movement of Artificial Intelligence (AI) research from universities to big corporations has had a significant impact on the development of the field. In the past, AI research was primarily conducted in academic institutions, which foster a culture of peer reviewing and collaboration to enhance quality improvements. The growing interest in AI among corporations, especially regarding Machine Learning (ML) technology, has shifted the focus of research from quality to quantity. Corporations have the resources to invest in large-scale ML projects and (...) they are often more interested in fast results than in ensuring that AI algorithms are reliable and safe. This paper proposes that the description of a Darwinian process made by the mathematician and physicist Freeman Dyson can be used to understand the implications of ML research scenario. The context of the Darwinian process—or lack thereof—can be used to draw a parallel between historical and current implications of technology expansion strongly driven by economic interests, making clear the consequences of shifting AI research from academia to industry. Finally, this paper indicates future directions for AI research to create a healthier environment for the evolution of ML technology. (shrink)

A mineradora Vale S.A., ativamente atuante na região de Mariana e Ouro Preto, no Estado de Minas Gerais, idealizou um projeto direcionado à Educação Patrimonial que durante 8 anos foi considerado como um dos principais projetos com viés cultural da região. Neste contexto, considerando que a Educação Patrimonial é de extrema importância para a formação da identidade cultural e social do indivíduo autônomo, objetiva-se analisar, sob a perspectiva crítica, as inter-relações entre o Programa de Educação Patrimonial Trem da Vale com (...) o conceito que carrega a Indústria Cultural, conforme cunhado pelos teóricos críticos Theodor Adorno e Horkheimer no livro “Dialética do Esclarecimento” (1985). Para tanto, para a realização da análise empírica utilizou-se como categoria de sentido a tese de Francisco Rüdiger (2004) sobre os esquematismos interpretativos comumente presentes nas práticas da Indústria Cultural. Contemporary philosophers have paid increasing attention to the empirical research on emotions that has blossomed in many areas of the social sciences. In this paper, I first sketch the common roots of science and philosophy in Ancient Greek thought. I illustrate the way that specific empirical sciences can be regarded as branching out from a central trunk of philosophical speculation. On the basis of seven informal characterizations of what is distinctive about philosophical thinking, I then draw attention to the fact (...) that scientific progress frequently requires one to make adjustments to the way its basic terms are conceptualized, and thus cannot avoid philosophical thought. The character of emotions requires attention from many disciplines, and the links among those disciplines inevitably require a broader philosophical perspective to be understood. Thus, emotion science, and indeed all of science, is inextricably committed to philosophical assumptions that demand scrutiny. (shrink)

We are living in a period where the balanced interdependence of fear and hope seems to have collapsed as a result of the growing polarization between the world of hopeless fear (great majority of the population) and the world of fearless hope (a strictly small but all powerful minority). It is a world where uncertainties tend to become abysmal ones which, for the poor and powerless, ultimately translate into unjust fate and, for the rich and powerful, a reckless mission to (...) appropriate the world. Under the present circumstances, the revolt and the struggle against the injustice must be waged in such a way as to bring about a new social redistribution of fear and hope to put an end to the hopelessness of the oppressed and the fearlessness of the oppressors. The struggle will be more successful if people come to realize that the hopeless fate of the powerless majorities stems from the fearless hope of the powerful minorities. (shrink)

How should we understand the emotional rationality? This first part will explore two models of cognition and analogy strategies, test their intuition about the emotional desire. I distinguish between subjective and objective desire, then presents with a feeling from the "paradigm of drama" export semantics, here our emotional repertoire is acquired all the learned, and our emotions in the form of an object is fixed. It is pretty well in line with the general principles of rationality, especially the lowest reasonable (...) principles. Turned to the second part of this side of reasonable. I will inquire how emotional beliefs, desires, and behaviors contribute to the rationality. I will present a very general biological hypothesis: emotions by controlling highlights the characteristics of perception and reasoning, so that we remove the difficulties due in particular to lead to paralysis; they are being simulated by a simplified perception of information, thus limiting our practice and cognitive choice. How are we to understand emotional or axiological rationality? I pursue analogies with both the cognitive and the strategic models, testing them against intuitions about emotional desires. We distinguish two different classes of desires, the subjective and the objective, and propose that emotions have a semantics that derives from "paradigmatic scenarios", in terms of which our emotional repertoire is learned and the formal objects of our emotions fixed. This fits in well with emerging facts about how our emotional capacities develop, and it can also be squared with the general principles of rationality, particularly minimal rationality. In the second part, I return to the perspective of rationality. I ask how emotions contribute to the rationality of beliefs, desires, and behavior. I proffer a very general biological hypothesis: Emotions spare us the paralysis potentially induced by a particular predicament by controlling the salience of features of perception and reasoning; they temporarily mimic the informational encapsulation of perception and so circumscribe our practical and cognitive options. The Philosophical search for Natural Kinds is motivated by the hope of finding ontological categories that are independent of our interests. Other requirements, of varying importance, are commonly made of kinds that claim to be natural. But no such categories are to be found. Virtually any kind can be termed ‘natural’ relative to some set of interests and epistemic priorities. Science determines those priorities at any particular stage of its progress, and what kinds are most ‘natural’ in that sense is (...) always a real and lively scientific question. The general philosophical problem of scientific realism is also real; but between the scientific and the metaphysical, the ‘Problem of Natural Kinds’ sits otiose. (shrink)

Ao longo da história da filosofia, John Locke tem sido frequentemente associado à tradição do liberalismo político, o que decorre, invariavelmente, de um modo peculiar de interpretação da noção de liberdade para o filósofo, que estaria estruturada em torno da ideia de não-interferência. Derivada frequentemente de propostas analíticas realizadas em um “vácuo histórico”, em que as ideias de Locke são tomadas como uma estática coleção, tal conclusão expressa uma perspectiva que não considera o caráter essencialmente discursivo da filosofia política e (...) o “campo problemático” em que os conceitos foram pensados pelo filósofo. Diante dessa perspectiva, o propósito deste artigo é o de realçar, na linguagem política utilizada pelo filósofo, os elementos contextuais que permitem a compreensão dos argumentos desenvolvidos pelo autor como parte de uma _performance_ – na acepção proposta por John Pocock –, a fim de destacar os aspectos que indicam a possibilidade de aproximação do conceito de liberdade de Locke da ideia de liberdade republicana, descrita por Philip Pettit a partir da ideia de não-dominação, sem descuidar da análise das evidências textuais que indicam a presença de argumentos na obra do autor que compõem o cerne da concepção republicana de liberdade. O INSTITUTO DA TUTELA NO ORDENAMENTO JURÍDICO BRASILEIRO: ASPECTOS PRINCIPIOLÓGICOS E GERAIS.

O artigo trata de uma revisão sistemática de literatura, com o objetivo de analisar os estudos existentes sobre o cuidado institucional ao professor universitário e o cuidado praticado pelo professor nas suas ações educativas. Foi feito um levantamento de artigos e teses no portal de periódicos da CAPES, publicados no período de 2010 a 2023, com os seguintes termos de busca: cuidado, educação, ensino superior, professor universitário, qualidade de vida, trabalho, saúde mental, saúde docente, bem-estar docente, acolhimento e promoção de (...) saúde. Foram incluídos estudos sobre o cuidado ao docente no ensino superior e as suas ações do cuidar nas práticas da área de Humanas. A análise embasou-se na Psicologia Histórico-Cultural articulada por Vygotsky, realizando a leitura na íntegra dos nove estudos incluídos, sendo sete artigos e duas teses, organizados em duas categorias: cuidado institucional ao professor universitário e o cuidado exercido pelo docente universitário na sua prática profissional. Os resultados mostram que o cuidado ao docente universitário tem sido vivenciado por ações pontuais sobre qualidade de vida no trabalho. Foi percebida a carência de estudos que identifiquem questões implicadas no cuidado ao docente de caráter institucional e que apresentam as práticas educativas no ensino superior como ato de cuidado. According to Hegel, universal history goes from the East to the West. This idea underlies the dominant conception of the 20th century as the European American Century. In this article, I submit that there has been another, subaltern 20th century, the Nuestra AmericaAmerican Century. The European American Century carries into the new millennium its empirical arrogance in the form of neoliberal globalization; the Nuestra AmericaAmerican Century, to be reinvented, bears the seeds of counter-hegemonic globalization. Counter-hegemonic globalization is understood as a (...) set of transnational alliances and struggles focused on the dynamic equilibrium between the principle of equality and the principle of difference. The article identifies five main themes in which the clash between the two alternative globalizations will occur in the next decades. (shrink)

Open peer commentary on the article “Design Research as a Variety of Second-Order Cybernetic Practice” by Ben Sweeting. Upshot: I claim that the parallels between design research, second-order cybernetics and second-order science, as discussed by Sweeting in the target article, are more explicit in digital design. The discussion of SOC and SOS can point towards the creation of an epistemological foundation to digital design, where self-reflexivity and the inclusion of the observer are central questions.

The essay situates Zwicky between the analytic and Continental traditions in philosophy: like the best analytic philosophers, it is argued, she is enamored of clarity, but, like what is best in the Continental tradition, she demands of philosophy a deeper sense (...) of meaning than philosophical analysts tend to do. It is from this unusual position that Zwicky is said to challenge the dogmas of the analytic tradition. Notable among those treated in this article are the belief that attributing literal meaning to anything but linguistic items is futile, belief in the possibility of distinguishing literal from metaphorical meaning, belief in the supremacy of argument over aphorisms, and belief in the importance of the “reductionist” program, which seeks to understand wholes in terms of their parts.
